San Bernardino cars going in and out of the warehouse

A cornerstone environmental finding used to grant approval of a large warehouseparcel delivery center in northwest Upland was thrown out last week by a judge, who also set aside the companion development agreement that promised the city 17 million over 20 years for police, parks and downtown enhancements.

In his ruling, San Bernardino County Superior Court Judge David S. Cohn gave Upland Community First a partial victory over the city of Upland and Bridge Development Partners. He ruled that the defendants conclusion the project would not go above a certain threshold for greenhouse gases and therefore would have no significant effect on the environment was without adequate support.

The city and developer were directed by Cohn to find the most accurate threshold one supported by substantial evidence for greenhouse gas emissions, namely carbon dioxide, which would be released by trucks, vans and cars going in and out of the warehouseretail center. He threw out the development agreement because the city relied on a related document, an environmental review called a Mitigated Negative Declaration, at the time the City Council approved the project and all its agreements.
