The murder and disappearance of Albert Fountain and his eight-year-old son, Henry, in February 1896, is one of the great mysteries of the southwest. No one knows for certain what actually happened to the Fountains except that the circumstantial evidence is very strong that they were murdered and it is a fact that their bodies were never found.

Who murdered them and why has been the engine of speculation and rumors for the past 120 years. A frantic search for the Fountains began after they disappeared in the cattle country of the Tularosa basin in February 1896. The search parties were led by the Fountain brothers, Albert Jr. and Jack, and W. H. H. Llewellyn, a former Mescalero Indian agent and prominent Las Cruces attorney and friend of the Fountain family. By the time the search parties returned empty handed many believed that Oliver Lee was responsible for murdering Albert and Henry Fountain. The pressure was building for the start of a bloody range war in the bitter feud between the small operators and investors in the big cattle companies.

Garrett spent the next two years gathering evidence against Oliver Lee and his friends. A few weeks before the grand jury was to meet in the spring of 1898, rumors began to fly that Pat Garrett was ready to present his evidence to the jury and serve indictments on Oliver Lee and others. The charges against made Lee and others were dramatically affected by a poker game played in Tularosa, New Mexico, before the grand jury had even met in Las Cruces.
